Parkwide Terms of Use

These terms are an agreement between you and [Company legal name] (“we”) for the Parkwide app, its Apple Watch app, and parkwideapp.com (together, “Parkwide”). By creating an account or using Parkwide, you agree to them. If you don’t agree, please don’t use Parkwide.
The app is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”, https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These terms add to it. If they conflict, these terms apply, except where the Standard EULA says it must control.
Your account
- You need an account to use Parkwide. Give a real email address you can receive mail at, and keep your password to yourself.
- You’re responsible for what happens in your account. Tell us promptly if you think someone else is using it.
- You must be at least 13 years old to create an account. If you’re under 18, a parent or guardian must agree to these terms for you.
- You can delete your account at any time in More › Account › Delete account.
What Parkwide is, and what it isn’t
- Parkwide shows wait times, ride status, park hours, forecasts, crowd estimates and weather. It gets this information from public sources and from our own estimates.
- The information can be late, incomplete or wrong. A ride can close or a wait can change after we last checked. Forecasts and crowd scores are estimates, not promises. The posted wait and the park’s own staff and apps are the final word.
- Alerts are best effort. Push notifications depend on Apple, your phone, your settings and your connection, and they can arrive late or not at all. Don’t rely on Parkwide alone for anything time-critical or safety-related.
- Parkwide is independent. It is not affiliated with, endorsed by or sponsored by any theme park or its owners. Park and attraction names belong to their owners and are used only to identify them. Parkwide doesn’t sell tickets or book anything for you. You book directly with the park.
- Always follow the park’s rules, ride restrictions and posted instructions. Please don’t use your phone in ways that are unsafe or against the rules in line or on a ride.
Parkwide Pro
- Parkwide Pro is an optional subscription that adds wait, ride and park alerts. Live waits, the Watchlist, favorites, weather and trip plans are free.
- Pro is sold through the App Store as an auto-renewing subscription, billed monthly or yearly at the price shown before you buy. Payment is charged to your Apple Account when you confirm the purchase.
- It renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
- To cancel or manage Pro, go to Settings › Apple Account › Subscriptions on your iPhone. Cancelling stops the next renewal, and Pro stays on until the end of the period you’ve paid for.
- Refunds are handled by Apple under its policies. Request one at https://reportaproblem.apple.com.
- Deleting your Parkwide account doesn’t cancel the subscription. Cancel it with Apple.
- We may change what Pro includes or its price. Apple will tell you before a price increase applies to your subscription, as its rules require.
Acceptable use
Don’t:
- use Parkwide to break the law or anyone’s rights;
- try to get into accounts or systems that aren’t yours, or test, probe or break our security;
- scrape, copy or resell Parkwide’s data, or use automated tools to access it without our written permission;
- overload, interfere with or reverse-engineer the service, except where the law allows it;
- use Parkwide to build a competing service.
We may suspend or close accounts that break these rules or put the service or other people at risk.
Your content
Trips, notes, favorites and other things you save stay yours. You give us permission to store and process them only to run Parkwide for you, as described in our Privacy Policy.
Our content
Parkwide, its design, code, estimates and branding belong to us or our licensors. Weather data is provided by Apple Weather, and its sources are listed at the attribution link in the app.
Changes and availability
- We may add, change or remove features, or stop offering Parkwide or support for a park.
- If we stop offering Parkwide Pro, we’ll stop renewals.
- We may update these terms. When we do, we’ll change the date at the top, and we’ll tell you in the app or by email about significant changes. Using Parkwide after the changes take effect means you accept them.
Disclaimers and limits
To the fullest extent the law allows:
- Parkwide is provided “as is” and “as available”, without warranties of any kind, including accuracy, fitness for a particular purpose, and non-infringement.
- We aren’t liable for indirect, incidental, special, consequential or punitive damages, or for missed rides, lost time, travel costs or lost data.
- Our total liability for any claim about Parkwide is no more than the greater of the amount you paid us for Parkwide in the 12 months before the claim, or US$50.
Some places don’t allow these limits, so they may not all apply to you. Nothing here limits rights you have under consumer law that can’t be waived.
Governing law
These terms are governed by the laws of [State], USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in [County, State], unless the law where you live gives you the right to bring them elsewhere.
Apple
As the Standard EULA says, these terms are between you and us, not Apple. Apple isn’t responsible for Parkwide or its content, has no duty to provide maintenance or support, and is a third-party beneficiary of these terms with the right to enforce them against you.
